General terms and Sales conditions

Preamble

Any order placed on www.unsoiralopera.com website (hereinafter referred to as "the Site") of the company UN SOIR A L'OPERA (hereinafter referred to as "the Seller") will be exclusively subject to the present general conditions of sale, which we advise you to read carefully. The act of placing an order implies that the present general conditions of sale have been consulted beforehand and are fully and irrevocably accepted. The Site, source code, texts, images and other elements of the Site are the exclusive property of the Seller. The entire contents of the Site are protected by copyright laws. Therefore, and in accordance with the provisions of the Intellectual Property Code, the Site may only be used for personal purposes. Otherwise, the offender runs the risk of prosecution in the relevant court of law.

Article 1: Acceptance of the present general conditions of sale

The present general conditions of sale (hereinafter referred to as "general conditions") define the rights and obligations of each party involved in the online sale of products proposed by the Seller on the Site. The Customer acknowledges being informed of the present general conditions when confirming the order.

Article 4: Price of products and total cost of an order

4.1. Sale prices of products

The sale prices of products are those shown on the Site at the time of purchase. These sale prices are quoted inclusive of VAT, at the rate applicable on the day the order is placed, but do not include charges for gift wrapping or postage, which will both be added to the bill. Any change in the VAT rate will automatically affect the sale price of products. PLEASE NOTE: for delivery outside the European Union, the Customer must also pay customs duties and any other taxes due on products imported into the country of delivery.

4.2. Total amount due on an order

Payment must be made when the Purchaser places his online order. At no time can the sums paid be considered as deposits or part payments. All orders are payable in euros, including taxes and compulsory contributions.

4.3. On-line order

To pay for his order, the Purchaser can use the following payment method:

The Purchaser or the addressee of the ordered products is invited to check the outward condition of the products on delivery.

In the presence of a visible fault (damage, missing product compared to the delivery note, parcel or product damaged or broken, etc.), noted during the delivery in the presence of a La Poste employee, the Purchaser or the addressee of the ordered products must apply the La Poste Colissimo procedure, particularly by pointing out the damage or missing items noted and by stating any claims and reservations and refusing the delivery by immediately issuing a declaration of complaint with the La Poste employee (declaration 170).

The Purchaser or the addressee of the ordered products has a period of three clear days from receiving the order to notify the carrier, by registered letter with acknowledgment of receipt, of any incident relating to the condition or content of the delivered parcel. He is also invited to point out the problem encountered to UN SOIR A L’OPERA by immediately sending an email to UN SOIR A L’OPERA customer service: contact@unsoiralopera.com

DELIVERIES

All parcels are delivered with Colissimo or Postexport and a tracking number will be sent to you to track your deliveries on http://www.colissimo.fr/portail_colissimo/suivre.do?language=en_GB

The shipping cost is based on the total weight of the orders.

DELIVERY LEAD-TIMES

For any order confirmed from Monday to Friday (excluding public holidays) before 1 p.m. on the UN SOIR A L’OPERA website, the order will be prepared within 48 hours, within the limit of available stocks.

If a product is not available, UN SOIR A L'OPERA will advise the purchaser and will do its best to send the order as soon as possible.

Delivery lead-times, following validation of your order, are the following:

Tracked parcel from La Poste: less than or equal to 5 working days for France and 8 working days for the eurozone outside France.

In the event these times are exceeded by 7 days and not due to a force majeure event, the Purchaser will be entitled to cancel his order by registered letter with acknowledgment of receipt sent to UN SOIR A L’OPERA.

Some products can be picked up directly in Boulogne-Billancourt France. In this case, a meeting will be arranged for the delivery 8bis allée Maillasson - 92100 Boulogne Billancourt by email after the payment of the order.

UN SOIR A L’OPERA will then make inquiries with the carrier concerned prior to reimbursing the undelivered ordered products.

Guarantees Pursuant to article L. 121-20 of the French Consumer Code, the Purchaser has a period of 7 (seven) clear days from the day his order is received by him or by the addressee of the order, to return at his expense all of his order and obtain, on his choosing, an exchange of products, or a credit note or reimbursement corresponding to the amount of his order.

The products must without fail be returned to UN SOIR A L’OPERA according to one of the procedures set out below.

The delivered products can be returned by the Purchaser to UN SOIR A L’OPERA under the conditions and according to the instructions set out below. Products must without fail be returned UN SOIR A L’OPERA in a perfect resale condition or in their original condition (packaging, accessories, and instructions).

UN SOIR A L’OPERA accepts the return by parcel or by letter of any article bought on www.unsoiralopera.com if it is returned to UN SOIR A L’OPERA within a period of 8 (eight) days from the date the Purchaser receives the order. Postage costs for returning the parcel are paid for by the Purchaser, except in the event of non-conformity of the delivered products compared to the order. The initial delivery costs are not reimbursed to the Purchaser except in the cases stated in the above delivery information relating to delivery lead-times or concerning exercising the right of retraction, or in the case of non-conformity of the delivered products compared to the order.

Information Technology and Freedom

The nominative information the Customer is asked to provide is needed to process and dispatch orders as well as to draw up delivery slips and invoices. The personal data collected is treated by the Seller with respect in accordance with the legal provisions concerning data privacy decreed by French Law no. 78-17 of 6 January 1978, known as "Information Technology and Freedom":
